Warranty

Icetro America (the “COMPANY”), as a warranty administrator of Icetro brand Ice Maker sold in the USA and Canada, warrants only to the original owner, for the period of 36 (thirty six) months that the new ice maker (the “PRODUCT”) manufactured by Icetro shall be free of defects in material or workmanship under normal and proper use and maintenance as specified by the COMPANY. For slush machines, the period is 12 (twelve) months. This warranty depends upon proper installation and start-up in accordance with the instruction manual supplied with the PRODUCT. An additional 24 (twenty four) months shall apply to the compressor and evaporator as explained below. Warranty registration, as indicated in the instruction manual, must be completed within 10 days of the original installation date to validate the product warranty. In the event that proper registration has not been completed, the warranty shall begin from the distributor sold date.

The obligation of the COMPANY and the rights and remedies of the owner/user under this warranty are exclusively limited to the repair or replacement of parts or assemblies that in opinion of the COMPANY are defective. This warranty is further limited to the cost of parts, components or assemblies and standard straight time labor charges at the servicing location and shall exclude any additional expenses. Additional expenses include without limitation, travel time, overtime premium, accessing or removal of the ice maker, or shipping or other premium charges. Labor charges covered under this warranty, must be performed by a refrigeration service company qualified and accepted by the COMPANY and/or the COMPANY’s local Distributor. The total liability of the COMPANY under this warranty shall in no event be greater than the actual purchase price paid by the customer for the ice maker.

The foregoing warranty shall not apply to (1) any part or assembly that has been altered, modified, or changed; (2) any part or assembly that has been subjected to misuse, abuse, neglect, or accidents; (3) any Product that has been installed and/or maintained inconsistent with the technical instructions provided by the COMPANY, or (4) any Product that has been installed or is located outside the USA or Canada.

This warranty shall not apply if the Product’s refrigeration system is modified with a condenser, heat reclaim device, or parts and assemblies other than those manufactured by the COMPANY, unless the COMPANY approves these modifications for specific locations in writing. In the event a warranty call is made to an authorized service company, and the problem is determined to not be a warranty issue the service company must be paid by the party requesting warranty service. Problems concerning water and electrical supply and or lack of maintenance and sanitation, or equipment abuse is the responsibility of the party requesting warranty service. If the service company is not paid by the customer for work not covered under warranty, ICETRO could choose to pay service company and warranty can be canceled.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES OR GUARANTEES OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. In no event shall the COMPANY be liable for any special, indirect, incidental or consequential damages. Upon the expiration of the warranty period, the COMPANY’s liability under this warranty shall terminate. The foregoing warranty shall constitute the sole liability of the COMPANY and the exclusive remedy of the customer or user.
